Abstract
Data privacy is a critical concern in India’s rapidly digitizing ecosystem. This paper analyzes the efficacy of the Information Technology Act 2000 and related provisions in safeguarding user data. It examines key challenges including loopholes in legal frameworks inadequate enforcement mechanisms and emerging threats like data breaches and surveillance. By exploring case studies of cyber incidents the study highlights the need for comprehensive data protection legislation. Recommendations include adopting global best practices enhancing digital literacy and fostering collaboration between stakeholders. The paper underscores the urgency of strengthening India’s cybersecurity infrastructure to protect individual rights and maintain trust in digital platforms.
