Freedom of Speech vs. Hate Speech: A Legal and Ethical Analysis in the Indian Context

Abstract
The right to free speech and expression is fundamental to every democratic society. Nevertheless the abuse of this privilege often results in hate speech which jeopardises social cohesion and poses a challenge to constitutional administrations. This study investigates the complex interplay between freedom of expression and hate speech in India by analysing its legal ethical and sociological aspects. This study aims to provide a detailed knowledge of the issue via an examination of constitutional provisions key court judgements and ethical concerns. The research underscores the need for more rigorous enforcement of current regulations and accentuates the significance of ethical accountability in the practice of free speech.
